Terms of Service

Effective date: 1 September 2026

By accessing the Coco Marlowe website or purchasing from us, you agree to these Terms together with the policies referenced below.

1. General

This website and online store are operated under the Coco Marlowe brand. Throughout the site, 'we', 'us' and 'our' refer to the operator of Coco Marlowe.

By accessing the website, using its features or purchasing products, you agree to these Terms of Service together with the policies referenced in them, including the Refund, Returns & Exchanges Policy, Shipping & Delivery Policy and Privacy & Data Handling Policy.

Nothing in these Terms excludes, restricts or modifies rights that cannot lawfully be excluded under the Australian Consumer Law or other applicable mandatory law.

2. Eligibility and Lawful Use

You must be legally capable of entering into a purchase contract or use the store with the involvement of a parent or guardian where required. You must not use the website, products or services for unlawful or unauthorised purposes.

3. Product Information

We make reasonable efforts to describe and display products accurately. Device displays, lighting, photography and manufacturing variations may cause minor differences in colour or appearance.

Product information, availability, specifications and descriptions may be updated from time to time.

4. Pricing and Currency

Prices shown to Australian customers may be displayed and charged in Australian dollars where supported by Shopify Markets and the selected payment method, while Coco Marlowe may maintain internal accounting or base-price settings in another currency.

Displayed prices, promotions and discounts may change without notice before an order is placed. Once an order has been accepted, the amount charged is governed by the confirmed order except where an obvious pricing or system error requires correction in accordance with applicable law.

5. Obvious Pricing or System Errors

Despite reasonable care, a product may occasionally be displayed with an obvious pricing, typographical or technical error. Where the error is genuine and materially different from the intended price, Coco Marlowe may contact the customer, cancel the affected order and provide a full refund rather than fulfil the order at the erroneous price, to the extent permitted by law.

This clause is not intended to permit misleading pricing practices or remove any statutory right.

6. Order Acceptance

Submitting an order does not necessarily mean that Coco Marlowe has accepted it. We may decline or cancel an order where reasonably necessary, including suspected fraud, payment failure, product unavailability, duplicate orders, delivery restrictions or a genuine pricing or system error.

If an order is cancelled after payment and no valid charge remains due, the applicable amount will be refunded.

7. Payment

Payments are processed through Shopify and available third-party payment providers. The payment methods offered at checkout may vary by location, device, currency and provider availability.

Customers must provide accurate billing and payment information and are responsible for ensuring they are authorised to use the selected payment method.

8. Shipping and Fulfilment

Orders may be fulfilled through international third-party fulfilment partners and carriers. Australian orders are shipped using DDP or equivalent prepaid-import arrangements, so the amount paid through the website is intended to be the final amount due and no additional import charge should be payable to the carrier on delivery.

Shipping methods, processing, tracking and failed-delivery procedures are governed by the Shipping & Delivery Policy.

Because fulfilment may begin quickly after an order is placed, cancellations and address changes cannot be guaranteed after processing has started.

9. Returns, Exchanges and Refunds

Voluntary change-of-mind returns, Simplified Size Exchanges, alternative resolutions, Return Authorisations, dispatch deadlines and return procedures are governed by the Refund, Returns & Exchanges Policy.

A voluntary return policy does not replace or limit statutory consumer guarantee rights.

10. Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.

Where applicable, customers may be entitled to remedies including repair, replacement, refund or compensation when goods fail to comply with a consumer guarantee. The appropriate remedy depends on the circumstances and seriousness of the failure.

Nothing in these Terms is intended to represent that Coco Marlowe's voluntary policies are the customer's only rights.

11. Customer Information

Customers must provide current, complete and accurate information reasonably necessary to complete a purchase and delivery, including contact and shipping information.

Coco Marlowe is not responsible for avoidable delivery problems caused by inaccurate information supplied by the customer, subject always to applicable law.

12. Third-Party Tools and Services

The website may rely on or link to third-party tools and services such as Shopify, payment gateways, shipment tracking, review platforms, analytics, marketing services and external websites.

Third-party services may be subject to their own terms and privacy policies. To the extent permitted by law, Coco Marlowe is not responsible for independent third-party websites or services outside our reasonable control.

13. User Reviews, Feedback and Submissions

If you voluntarily submit a review, photograph, comment, suggestion or other content to Coco Marlowe, you grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce, adapt, publish and display that content for legitimate business and marketing purposes, subject to applicable privacy law and any specific limitations agreed with you.

You must not submit unlawful, defamatory, infringing, fraudulent or malicious content or content that violates another person's rights.

14. Intellectual Property

The Coco Marlowe name, branding, website design, original copy, graphics and other proprietary content are owned by or licensed to Coco Marlowe and may not be copied, reproduced or commercially exploited without permission, except as permitted by law.

15. Personal Information

Personal information submitted through the store is handled in accordance with the Privacy & Data Handling Policy. To fulfil an order, necessary delivery information may be shared with international fulfilment and logistics providers.

16. Marketing Communications

Where customers consent or where otherwise permitted by applicable law, Coco Marlowe may send marketing by email, SMS or other supported channels. Marketing consent can be withdrawn using the unsubscribe or opt-out method provided in the message.

Transactional communications relating to orders, payments, delivery or support may still be sent where reasonably necessary.

17. Errors, Inaccuracies and Updates

The website may occasionally contain typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, shipping estimates or availability. We may correct such information and update the website, subject to applicable consumer law and obligations relating to orders already accepted.

18. Availability and Store Changes

We may modify, suspend or discontinue website features, products or services from time to time. This does not affect rights or obligations already accrued under an existing purchase contract.

19. Limitation of Liability

To the maximum extent permitted by law, Coco Marlowe is not liable for losses that are remote, unforeseeable or caused by matters outside our reasonable control.

Any exclusion or limitation in these Terms operates only to the extent permitted by law. Nothing limits liability or remedies that cannot lawfully be excluded, including applicable rights under the ACL.

20. Indemnity

To the extent permitted by law, you agree to indemnify Coco Marlowe against reasonable losses arising directly from your unlawful use of the website, infringement of third-party rights, fraud or material breach of these Terms. This clause does not require a consumer to indemnify Coco Marlowe for losses caused by Coco Marlowe's own unlawful conduct or breach of mandatory law.

21. Severability

If any provision of these Terms is invalid or unenforceable, it will be read down to the minimum extent necessary or severed, while the remaining provisions continue to operate.

22. Governing Law

These Terms are governed by applicable Australian law to the extent it applies to the transaction. Mandatory consumer protections that apply to the customer are not excluded by this clause.

Any dispute will be dealt with in accordance with applicable law and before courts or tribunals having lawful jurisdiction. Nothing in this clause limits mandatory consumer protections available to the customer.

23. Changes to the Terms

We may update these Terms from time to time. The version published at the time an order is placed will generally govern that order, subject to mandatory law.
